These Terms of Service ("Terms") govern your use of the website thelkautoinc.com (the "Website") and the auto body repair and detailing services (the "Services") provided by The LK Auto Inc. ("we," "us," or "our"), a business operating in the Province of Ontario, Canada.

By accessing our Website or engaging our Services, you ("you" or the "Customer") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Services.

1. Services Overview

The LK Auto Inc. provides auto body repair, collision repair, paint repair, dent repair, scratch repair, paint correction, ceramic coating, paint protection film (PPF) installation, caliper painting, and related automotive services. All services are performed at our shop located at 773 Warden Avenue, Unit 7, Scarborough, Ontario M1L 4C2, unless otherwise agreed upon in writing.

2. Estimates and Quotes

Estimates provided through our Website, by phone, by email, or in person are provided for informational purposes only and do not constitute a binding contract or fixed price. Estimates are based on the information available at the time and are subject to change.

Upon physical inspection of your vehicle, the actual scope of work and final cost may differ from the initial estimate. Additional damage or necessary repairs may be discovered once work has commenced (for example, hidden damage beneath body panels). We will make reasonable efforts to notify you of any material changes in cost or scope before proceeding with additional work. Your verbal or written authorization is required before we perform work that significantly exceeds the approved estimate.

Estimates are valid for 30 days from the date issued, unless otherwise stated.

3. Authorization and Consent to Repair

By delivering your vehicle to our shop and signing a work order or providing verbal or written authorization, you grant us permission to perform the agreed-upon repairs and services. You represent that you are the legal owner of the vehicle or that you have proper authorization from the owner to request and approve repairs.

If we discover additional necessary repairs during the course of work, we will contact you for authorization before proceeding. If we are unable to reach you within a reasonable time and the additional work is necessary to safely reassemble or return the vehicle, we reserve the right to perform the minimum work required, for which you will be responsible for payment.

4. Insurance Claims

If your repairs are being processed through an insurance claim, you authorize us to communicate directly with your insurance company, adjusters, and appraisers on your behalf. You understand and agree that:

  • We do not guarantee the approval, timing, or amount of any insurance claim. Insurance coverage decisions are made solely by your insurance provider.
  • Any amounts not covered by your insurance policy, including deductibles, betterment charges, depreciation, or any denied portions of a claim, are your responsibility.
  • You are ultimately responsible for the full cost of repairs performed on your vehicle, regardless of the outcome of your insurance claim.
  • We are not your insurance broker, agent, or adjuster, and we do not provide insurance advice.

5. Pricing and Payment

All prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes (HST). Payment is due in full upon completion of services and before the release of your vehicle, unless a written payment arrangement has been made in advance.

We accept cash, credit cards, and debit cards. For insurance-covered repairs, we may bill your insurer directly where applicable, but you remain responsible for any balance not paid by your insurer, including your deductible.

If payment is not received when due, we reserve the right to exercise a repairer's lien under the Repair and Storage Liens Act (Ontario), which may include retaining possession of your vehicle until all outstanding charges are paid in full.

6. Vehicle Pickup and Abandonment

Once we notify you that your vehicle is ready for pickup, you are expected to retrieve it within 5 business days. Vehicles not picked up within this period may be subject to a daily storage fee.

Vehicles left at our premises for more than 60 days after completion of services without contact or payment may be deemed abandoned. In such cases, we will exercise our rights under the Repair and Storage Liens Act (Ontario), which may include selling the vehicle to recover outstanding charges. We will provide any required notices before taking such action.

7. Warranty

We stand behind our workmanship and offer the following warranties:

  • Collision repairs: Lifetime warranty on workmanship for as long as you own the vehicle. This covers defects in our repair work, including paint peeling, cracking, or flaking caused by faulty application.
  • Ceramic coatings: Warranty period varies by product (1–5 years). Coverage terms are as specified by the manufacturer.
  • Paint protection film (PPF): Covered by the manufacturer's warranty (up to 10 years depending on product). We will assist you with manufacturer warranty claims where applicable.

Warranty Exclusions

Warranties do not cover:

  • Damage caused by subsequent accidents, collisions, or impacts
  • Normal wear and tear, including stone chips, road debris, and environmental damage
  • Damage caused by improper maintenance, neglect, chemical exposure, or misuse
  • Damage caused by modifications or repairs performed by third parties after our original work
  • Rust or corrosion originating from pre-existing conditions or areas not repaired by us
  • Colour variation between repaired and original panels due to factory paint aging, fading, or prior non-original repairs
  • Parts that are covered under a separate manufacturer's warranty

To make a warranty claim, please contact us with your original work order details. We may need to inspect the vehicle to determine whether the issue falls within warranty coverage.

8. Limitation of Liability

To the fullest extent permitted by applicable law, including the laws of Ontario and Canada:

  • Our total liability to you for any claim arising from our Services shall not exceed the total amount you paid to us for the specific service giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use of your vehicle, loss of income, rental car costs, diminished vehicle value, or emotional distress, regardless of the cause of action.
  • We are not responsible for pre-existing conditions, defects, or damage to your vehicle that were present before we began work, including hidden damage, pre-existing rust, mechanical issues, or previous repair defects.
  • We are not responsible for personal items left in your vehicle. Please remove all personal belongings before leaving your vehicle with us.
  • We are not liable for delays in completing repairs due to factors outside our reasonable control, including but not limited to parts availability, supply chain disruptions, insurance processing delays, weather events, or government actions.

Nothing in these Terms is intended to exclude or limit any rights you may have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer protection legislation that cannot be excluded or limited by agreement.

9. Assumption of Risk

You acknowledge that auto body repair inherently involves some risk, including but not limited to the possibility that existing damage may be more extensive than initially visible, that paint colour matches may not be identical to factory original due to aging, and that repairs may reveal pre-existing structural or mechanical issues. We will communicate any significant findings to you, but we are not liable for pre-existing conditions.

10. Indemnification

You agree to indemnify and hold harmless The LK Auto Inc., its owners, employees, and contractors from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misrepresentation regarding vehicle ownership or authorization; (c) your failure to disclose known pre-existing conditions or damage; or (d) third-party claims arising from your use of our Services.

11. Website Use

Accuracy of Information

We make reasonable efforts to ensure the information on our Website is accurate and up to date. However, content is provided for general informational purposes only and may contain errors or omissions. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

Intellectual Property

All content on this Website, including text, graphics, logos, images, and software, is the property of The LK Auto Inc. or its licensors and is protected by Canadian copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

User-Submitted Content

When you submit photos, descriptions, or other content through our Website (such as through estimate request forms), you grant us a non-exclusive, royalty-free licence to use that content solely for the purpose of providing and improving our Services. We may retain photos of completed work for our portfolio and marketing purposes, with identifying information removed, unless you inform us otherwise.

Prohibited Uses

You agree not to use our Website for any unlawful purpose, to interfere with or disrupt the Website or its servers, to attempt to gain unauthorized access to any part of the Website, or to transmit any malicious code.

12. Third-Party Links

Our Website may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over and are not responsible for the content, accuracy, privacy practices, or availability of third-party sites. Inclusion of any link does not imply endorsement.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, supply chain disruptions, labour disputes, power outages, or acts of third parties.

14. Dispute Resolution

If a dispute arises between you and The LK Auto Inc. relating to these Terms or our Services, we encourage you to contact us first to attempt to resolve the matter informally. If we are unable to reach a resolution, the dispute will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario.

Nothing in this section limits your right to file a complaint with applicable regulatory bodies, including the Ontario Ministry of Public and Business Service Delivery or the Motor Vehicle Dealers Act enforcement agencies, where applicable.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written work order or estimate signed by you, constitute the entire agreement between you and The LK Auto Inc. with respect to the subject matter herein. No oral statements, representations, or warranties not contained in these documents shall be binding.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes become effective when posted on this page with an updated "Last Updated" date. Your continued use of our Website or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
